The misdemeanor domestic assault case against a Billings Clinic doctor has been dismissed.

Prosecutors filed to drop the case against John Wilson Verbsky, 47, who faced two misdemeanor assault charges and one charge of criminal destruction of, or tampering with, a communication device, also a misdemeanor.

The motion to dismiss without prejudice was made Wednesday. It said prosecutors and Verbsky agreed to a deferred prosecution agreement, which was not included in the case file.

Deferred prosecution typically means that, if a defendant remains law-abiding for a certain amount of time, the case is then expunged.

Verbsky, who no longer works at the Clinic, was arrested on Dec. 3 after his wife reported that he kicked her several times and punched her during an argument. One of their children witnessed the incident, charges stated.

Verbsky later told law enforcement that he acted in self defense. Court documents show that his family received benefits under the state Crime Victim Compensation Act.
