A Billings man was arrested after an investigation into his alleged sexual relationship with a 13-year-old girl.
Nicholas James Orr, 26, was charged with sexual intercourse without consent, a felony. He appeared in Yellowstone County Justice Court on Thursday.
Judge Pedro R. Hernandez set bond at $25,000 and ordered that Orr be put on GPS monitoring if released.
According to court documents, the girl was staying at Orr's home in 2013. When officers arrived, they found her "in a back bedroom closet" at the residence, charges state.
The girl disclosed to police that she had sex with Orr. Under Montana law, people younger than 16 cannot consent to intercourse.
The girl was taken to the hospital for a sexual assault exam. An analysis at the Montana Crime Lab matched Orr with the DNA retrieved during the exam, charges state.
Orr is scheduled to appear in Yellowstone County District Court on July 27.
