A Billings judge on Wednesday gave a man a partially suspended 20-year sentence for a 10th DUI conviction.

District Judge G. Todd Baugh sentenced 40-year-old William Robert Heaney to 20 years with the Department of Corrections, with 15 years suspended, for felony DUI.

The judge also issued six-month sentences each for misdemeanor counts of driving while license suspended or revoked and driving without insurance. Baugh also recommended Heaney for boot camp and a DOC treatment program.

The state was seeking a sentence of 10 years in prison with no time suspended, because Heaney threatens the safety of every member of the community unless he is in jail, according to sentencing memorandum filed by Deputy Yellowstone County Attorney Julie R. Patten.

According to Patten, this is Heaney’s fifth felony DUI offense and ninth felony overall.

Billings police arrested Heaney at about 3:15 a.m. May 28, 2013, after responding to a report of a “passed out” driver at the south end of Florine Lane, according to court records.

Officers found Heaney asleep in the truck with a key in the ignition, although the engine was not running.

Heaney showed signs of intoxication and became verbally abusive and combative toward the officers, court records state. He was placed in a restraint chair at the county jail.

He refused to give a breath sample, but a blood test analyzed at the state crime lab showed he had a blood-alcohol concentration of .144 percent.

According to prosecutors, Heaney has prior DUI convictions in 1992, 1994, 1996, 1997, 1998, 2002, 2003, 2006 and 2008.
