A man appeared in Yellowstone County Justice Court Thursday on a felony theft charge alleging he lied about having custody of his son in order to steal thousands of dollars in social security benefits from July 2010 to April 2012.

According to charging documents, Mark Alan Walnofer, 45, lied to the Social Security Administration about having custody of his 19-year-old son.

Court records say Walnofer kept monthly payments totaling $17,606 that were intended for his son. 

Walnofer is scheduled to enter a plea to the theft charge in District Court on July 10.

He remains free from jail after posting on a $50,000 bond.
