MISSOULA — The Montana Supreme Court has upheld a ruling that denied Carlyle Group’s request to stop the valuation process of Mountain Water Co., which the city of Missoula is trying to take ownership of.

The city recently won a court ruling allowing it to purchase Mountain Water, but the condemnation case has not been finalized and Carlyle is still the owner.

State Supreme Court found that Missoula County District Court was not mistaken when it denied Carlyle’s motion to stop the trial phase until the high court has a chance to rule on Carlyle’s appeal of condemnation.

The lower court found that the city was able to prove its plan for a city-owned water system is more necessary than its current use as a for-profit enterprise.
