HELENA — Rep. Steve Daines, R-Mont., voted with the House Republican majority Wednesday to sue President Barack Obama for what they say was exceeding his constitutional authority.

The vote was 225-201, with all but five Republicans voting to authorize the lawsuit. Democrats, joined by five conservative Republicans, voted against it.

Daines, who is running for the Senate this year, defended the lawsuit.

“Time and time again, the American people have seen President Obama delay and change laws unilaterally — or fail to execute laws altogether,” he said in a statement Thursday.

“Our constitutional system of checks and balances not only protects the American people from government overreach — it ensures that Americans’ voices are heard in their government. It’s important that the constitutional separation of powers is upheld no matter who is in the White House.”

Republicans aimed the legal action at Obama’s implementation of the Affordable Care Act, his revision of health laws, the Associated Press said.

Democrats denounced the lawsuit as a political move as Congress heads into a five-week recess.
