GREAT FALLS — A man whose son shot a 10-year-old Great Falls boy to death in March 2011 has been sentenced to 20 years in prison for raping a woman in September of that year.
During Gregg Allen Zindell's trial, the woman testified that she, Zindell and his brother had drinks and pizza at a bar and went back to Zindell's apartment. She said she was planning on going home, but after a couple sips from a drink she felt tired. Zindell offered to let her sleep in his bed. She testified she awoke to Zindell trying to have sex with her.
She said he put his arm across her throat and grabbed her wrists when she tried to get away. Court records say medical evidence was consistent with the woman's account.
District Judge Kenneth Neill sentenced Zindell on Tuesday to 30 years in prison with 10 suspended.
Zindell maintains his innocence and says he plans to appeal.
He was deemed a Tier I sex offender, a designation for those considered to be at the lowest risk of reoffending.
Zindell's son, who was 12 at the time of the shooting, pleaded "true" in Youth Court to felony negligent homicide. He was sentenced to placement in a juvenile treatment facility until he turns 18.
