HELENA — A 19-year-old Helena transient was arrested Friday after he admitted to having sexual intercourse with a woman while she was unconscious.

According to an affidavit supporting his arrest, Nicholas Grant Hafer told officers he had sex with the woman “without questions or probing from the officers and after being advised of his rights to remain silent.”

Hafer and the woman had been drinking in Butte with other friends and the woman, “had consumed an exuberant amount of alcohol and was extremely intoxicated,” the affidavit said. “(Witness 2) also stated the female victim vomited 5 times on the way back to Helena from Butte.”

According to the affidavit, the woman, “was so intoxicated that her words and sentences were unrecognizable.”

A sexual assault evidence kit was completed and Hafer was subsequently charged with felony sexual intercourse without consent, a warrant out of justice court with a $5,000 bond and a probation violation.
