Convicted in a large federal prosecution of medical marijuana providers, Miles City resident Justin Lane Flor on Thursday also admitted to having child pornography on his cellphone.

Flor, 35, pleaded guilty in U.S. District Court in Billings to possession of child porn. Flor, who is serving a five-year sentence on the marijuana charge, reached a plea agreement with prosecutors and admitted to the charges during a hearing before U.S. Magistrate Judge Carolyn Ostby.

The child porn investigation began in January when Miles City law enforcement got a tip that Flor was thought to be involved in a sexual relationship with a 14-year-old girl, said Assistant U.S. Attorney Marcia Hurd.

Flor repeatedly engaged in sexual activities with the girl at his residence and the two smoked marijuana together, Hurd said.

Investigators seized Flor’s cellphone and found three child porn movies that had been downloaded from the Internet, Hurd said.

The plea agreement calls for a joint sentencing recommendation of 10 years, which is the statutory maximum, and for the term to run concurrently with Flor’s marijuana sentence. Flor also agreed to forfeit his cellphone.

Ostby will recommend that Flor’s plea be accepted by Chief U.S. District Judge Richard Cebull, who will set a date and sentence Flor.

Flor and his parents, Richard and Sherry Flor, all convicted in the marijuana case, were part of the Helena-based Montana Cannabis LLC, which sold and distributed medical marijuana throughout the state. Flor pleaded guilty to conspiracy to manufacture and distribute marijuana and to possessing the drug for distribution.

Federal law enforcement officers raided Montana Cannabis and other medical marijuana providers in 2011.

Richard Flor, 68, was sentenced to five years in prison but died while in custody from medical complications. Sherry Flor, 54, received a two-year sentence.
