A 21-year-old man is accused of raping a 13-year-old at a Billings motel in January.

Emilio J. Walks appeared in Yellowstone County Justice Court on Monday on a single count of sexual intercourse without consent. Justice of the Peace David Carter set bond at $75,000. Walks remained in the county jail on Wednesday.

Walks connected with the girl on Facebook and had been messaging with her for three to four weeks before the two met in person, the girl later told law enforcement.

The two exchanged sexually explicit photos, charges state. After three or four weeks Walks asked the girl to meet him in person at the Lazy KT Motel to smoke marijuana and have sex. The girl responded that she was only 13 and did not want to have sex.

When the girl went to the motel, she reiterated that she did not want to have sex but Walks pressured her and ultimately coerced her into having sex, charges state.

Walks initially told law enforcement that he had never had contact with the girl, charges state. But when a detective confronted him with social media messages that showed he knew the underage girl was at the hospital receiving a sexual assault exam and he was worried she would name him, he admitted to having sex with her, charges state.

Walks also told law enforcement he’d tried to contact other underage girls on Facebook, charges state.
