A Billings man twice convicted of indecent exposure was given a 5-year suspended prison sentence Wednesday after his third conviction on the same charge.
Scott Dee Fergusson, 42, will have to complete sex offender treatment and abide by 31 other conditions in order to stay out of jail, District Judge Diane Barz ordered. Among the conditions, Fergusson must complete outpatient chemical dependency treatment and avoid contact with minors other than his own children.
Fergusson was arrested in March 2000 when a female neighbor told police he was smiling at her as he masturbated in his back yard. He was charged with indecent exposure and subsequently pleaded guilty. Fergusson has two prior convictions for indecent exposure.
A third conviction on the charge carries a possible sentence of five to 100 years in prison and a $10,000 fine. Fergusson was given the suspended prison sentence based on a plea agreement with prosecutors.
