HELENA - The Montana Supreme Court has rejected an appeal from a Eureka man convicted of murder in 2005.
Wayne Hixon was found guilty of shooting Robert Mast to death following a dispute.
Court records say a Lincoln County sheriff's deputy sent to investigate reports of a gunshot found Mast's body in his driveway.
Hixon was pulled over for speeding a short time later and arrested for drunken driving. His truck was towed from the scene and searched.
Court records say footprints found near Mast's body were later matched to a pair of shoes found in Hixon's truck.
Hixon argued on appeal that his truck was illegally seized.
In an opinion issued Monday, the Supreme Court disagreed. It said the truck was towed in accordance with Eureka Police Department policy, and a valid search warrant was obtained.
