CASPER - A federal judge must decide whether the Wyoming court system was wrong to prohibit a man convicted of killing his wife from arguing at trial that his brother might have been responsible for the crime.
U.S. District Judge Alan B. Johnson on Friday heard arguments from an attorney representing David Labon Bush. A state jury in 2007 found Bush guilty of second-degree murder in the death of his wife.
Lynn Bush disappeared in Natrona County in 1990 and her body has never been found.
A lawyer with the Wyoming Attorney General's Office responded that the state court's decision to block David Bush from suggesting his brother killed the woman was reasonable and didn't violate David Bush's constitutional rights.
Johnson will make a decision in the case later.
